Terms and Conditions of Service

1. Introduction

These Terms and Conditions govern the access to and use of the BigFishingPassion platform, operated by Tecno.Glob.In. di Gadotti Mauro. Registration on the platform implies the full reading and acceptance of this document.

2. Types of Users: Anglers and Guides

The Platform provides for two main types of user profiles, whose user flow is regulated by the chosen subscription plan and the role selected during registration.

Regular User ("Angler"): Can browse, search for itineraries, and interact with the available content.
Professional User ("Guide"): Has the right to upload content, descriptions, and offer their services on the platform in accordance with the rules set out in the following section.

3. Specific Rules for "Guides" (User Generated Content)

Users registered as a "Guide" have the ability to upload text, images, and itineraries. By uploading such content, the Guide represents and warrants that:

They are the exclusive owner of the copyright on the uploaded materials (photos, logos, texts) or hold the necessary usage licenses.
The content does not violate applicable laws, third-party rights, nor contain offensive, unlawful, or defamatory material.
They authorize the Platform to use, reproduce, and adapt the images free of charge to promote the Guide's own profile within the website.

Indemnification: The Guide agrees to indemnify and hold harmless Tecno.Glob.In. di Gadotti Mauro from any claim, damage, or legal action brought by third parties arising from the content uploaded by the Guide.

4. Communications between Anglers and Guides

In order to protect members' privacy and ensure the proper functioning of the service, the initial contact between an Angler and a Guide must take place through the Platform's dedicated internal messaging system. The Platform will forward the request by sending an email notification to the Guide.

Role of the Platform: Tecno.Glob.In. di Gadotti Mauro acts exclusively as a technical intermediary for forwarding the contact request. The Data Controller does not perform prior checks on the content of messages and is in no way responsible for any commercial agreements, provision of services, payments, or disputes that may arise privately between the Angler and the Guide following the contact made on the portal.

5. Subscriptions, Payments, and Waiver of the Right of Withdrawal

Access to certain features of the platform requires a subscription. Payments are managed securely by external payment gateways. All subscription plans are subject to a 12-month contractual commitment, regardless of whether the User chooses a single annual payment or split monthly installments.

No Refunds: Payments made are non-refundable under any circumstances, either in whole or in part, even if the User decides to stop using the platform before the natural expiration of the annual contract.

Exception to the Right of Withdrawal: Pursuant to Art. 59, letter o) of the Italian Consumer Code (Legislative Decree 206/2005) and the European Consumer Rights Directive, as this concerns the supply of "digital content through a non-tangible medium", the User expressly agrees that the execution of the digital service and access to exclusive content begins immediately upon payment.
Consequently, the User agrees to forfeit their right of withdrawal (the 14-day cooling-off period) once the subscription is activated.

Cancellation of Renewal: The user can disable the automatic renewal of the subscription at any time from their control panel. Such deactivation does not interrupt any monthly payments still due to complete the current contract year, but solely prevents the automatic renewal of the contract for the following year.

6. Limitation of Liability

Tecno.Glob.In. di Gadotti Mauro provides the platform "as is". The Data Controller is not responsible for the quality of the guiding services offered by third-party users, nor for any accidents, damages, or disputes that may arise privately between "Anglers" and "Guides" who met through the platform.

The management, maintenance, and security of the technological infrastructure are operated by Tecno.Glob.In. di Gadotti Mauro pursuant to the relevant service agreement.

7. Amendments to the Terms

The Data Controller reserves the right to modify these Terms at any time. Registered users will be notified in the event of material changes. Continued use of the Platform after the amendment constitutes acceptance of the new Terms.

8. Governing Law and Jurisdiction

These Terms are governed by Italian Law. For any dispute regarding their interpretation or execution, in the event that the user acts as a professional (e.g., Guide), the exclusively competent Court shall be that of Trento. If the user acts as a Consumer, the competent court is that of the Consumer's place of residence or domicile, as established by European law.
